Terms and Conditions for Use of Power to Learn Product and Services
Customer agrees to abide by the terms and conditions for the products and services selected on Attachment 2. The following parameters do not imply that a customer is entitled to all services. Attachment 2 sets forth those services, which the customer has hereby subscribed to. These terms and conditions are in addition to the parameters outlined in the Agreement.
Starter Network:
By choosing the Starter Network, customer acknowledges that it is accepting Cablevision's free commitment for Internet access designed to provide students, either in school or through their community libraries, with access to the Internet to assist in their educational pursuits. Therefore, by installing a Starter Network, the customer certifies and agrees to the following:
- The Starter Network is for student or library patron use only. This network is not sanctioned for use for any business operational needs of schools or libraries (e.g., administrative use, bus depot). Schools needing Internet access for these needs can select from Power to Learn's fee-based packages, offered at discounted rates for the K-12 education community.
- Customer must use the router supplied by Cablevision at installation. For existing customers, Cablevision reserves the right to contact you at any time to replace your existing router (if applicable) pursuant to the usage terms of this package. A router may be installed by Cablevision even if service is only to be used for Internet access to a single workstation.
- No Internet services can run behind the router, including but not limited to Email, Web, FTP, Terminal Service, and PCAnywhere. Cablevision will assign the private Internet Protocol (IP) scope. The router will automatically assign the addresses. Customers will not be allowed to run their own firewall device and/or other programs.
- This network is only to provide Internet access for up to 25 computers.
- Schools and libraries are entitled to only one Starter Network package per school. Additional packages can be selected from Power to Learn's fee-based offerings.
- Cablevision reserves the right to monitor usage of the network and/or to impose restrictions on the network necessary to enforce usage guidelines.
- Any violation of these terms of usage for this free service including but not limited to removal of the Cablevision router and the running of Internet services will be deemed a violation of this contract, subjecting you to penalties including but not limited to additional fees, payment of fees for violations from prior periods and termination of service.
Single Workstation:
The single workstation is designed for customers who have a need for Internet access at a single workstation that falls beyond the allowable terms of the Starter Network. By choosing Internet access for a single workstation, customer agrees to the following:
- Access will be used only for a single computer workstation. Connecting multiple computers using a router is expressly prohibited.
- Cablevision reserves the right to monitor usage of the network. In addition, Cablevision reserves the right to install a router at any point during this Agreement for the purposes of ensuring that the Internet access is only being used for a single workstation.
- Customers that already have a fee-based service for Internet access from Power to Learn are eligible to receive a discounted rate for the single workstation. Should Customer discontinue their fee-based service for Internet access during the terms of this Agreement, they would no longer be entitled to this discount. At that time, the higher fee for this package would then apply.
- Any violation of these terms of usage for this service including but not limited to removal of the Cablevision router, connecting multiple workstations and the running of Internet services will be deemed a violation of this contract, subjecting you to penalties including but not limited to additional fees, payment of fees for violations from prior periods and termination of service.
Level 1:
This package is intended to support up to 125 computers for Internet browsing as well as schools with limited data needs such as small data transfer and light FTP. This is also a good option for schools and libraries looking to provide Internet access for administration and support personnel.
By selecting the Level 1 package, customer certifies and agrees to the following:
- Customer will abide by the usage guidelines of this package and promptly notify Cablevision of any changes to use of service to ensure subscription to appropriate package.
- Cablevision reserves the right to monitor usage of the network and/or to impose restrictions on the network necessary to enforce usage guidelines.
- Cable modems are on a shared network and speed, uninterrupted use of service and sustained bandwidths are not guaranteed. Concurrent use of multiple Internet services may result in degradation of response time. Schools and libraries with more advanced needs requiring dedicated bandwidth should contact Power to Learn to learn more about a Lightpath solution.
- Any violation of these terms of usage for this service may subject you to penalties including but not limited to additional fees, payment of fees for violations from prior periods and termination of service.
Level 2:
This package is intended to support up to 230 computers for Internet browsing as well as schools looking to use the network for more complex data needs such as hosting email and web servers, heavier FTP and light video conferencing.
By selecting the Level 2 package, customer certifies and agrees to the following:
- Customer will abide by the usage guidelines of this package and promptly notify Cablevision of any changes to use of service to ensure subscription to appropriate package.
- Cablevision reserves the right to monitor usage of the network and/or to impose restrictions on the network necessary to enforce usage guidelines.
- Cable modems are on a shared network and speed, uninterrupted use of service and sustained bandwidths are not guaranteed. Concurrent use of multiple Internet services may result in degradation of response time. Schools and libraries with more advanced needs requiring dedicated bandwidth should contact us to learn more about a Lightpath solution.
- Any violation of these terms of usage for this service may subject you to penalties including but not limited to additional fees, payment of fees for violations from prior periods and termination of service.
Cablevision Leased Router - Only available to Customers selecting a Level 1 or Level 2 Package:
If a Customer has chosen to lease a router from Cablevision, your monthly maintenance includes but is not limited to proactive monitoring, opening of ports and trouble shooting as long as such maintenance and customer requests are consistent with the allowed usage guidelines of the subscribed package. In addition, Cablevision will repair or replace a defective router as long as such damage was not caused by misuse or other improper operations or handling by customer.
For existing router customers:
Customers understand that routers have a useful life of 3 years. After that time, should you decide to continue to use a Cablevision router, when you experience any problems, you will be subject to a one-time set-up fee for a new router and a monthly maintenance fee at Power to Learn's then available rates.
Static IP:
If Customer has chosen to be provisioned with a Static IP address:
- The IP address assigned by Cablevision to Customer will remain the property of Power to Learn and is non-portable. Cablevision does not give the customer any interest, title or license in the IP address that is assigned to the customer in conjunction with this service.
- Cablevision reserves the right to change the customer's assigned IP address in the event that Cablevision needs to upgrade and/or make changes to the Hybrid Fiber Coax (HFC) network resulting in a renumbering and/or reassignment of IP addresses. Cablevision will change Customers IP address only when absolutely necessary. Cablevision will make best efforts to provide advanced notice to Customer. Such changes may result in a brief period of outage.
Web Page Filtering:
If Customer has chosen to use Web Page Filtering provided by Power to Learn:
Starter Network Customers Only:
- Customer understands that in order to receive filtering on the Starter Network, 1) each computer must be connected via the Power to Learn Internet connection and Cablevision provided router, and 2) Customer is responsible for configuring the proxy settings on the browser of each individual computer on the Starter Network. Instructions will be provided.
- All schools are responsible for maintaining proper computer and browser settings for filtering. Failure to set up or maintain proper settings may circumvent filtering.
- Starter Network filtering is provided through a 3rd party and includes the standard list of blocked Web sites from the 3rd party. Customer will not have control over which sites are blocked. In addition, Cablevision does not control which sites are blocked and is unable to change settings per school request. Cablevision will provide a list of blocked categories to Customer upon request.
Level 1 and Level 2 Customers Only:
- Customer understands that in order to be eligible to purchase web page filtering from Power to Learn, Customer must also lease a Cablevision router and Static IP address. The Cablevision installed router directs all traffic to filter servers.
All Filtering Customers:
- Cablevision will not be held responsible for any other filtering product that may be downloaded or installed by the Customer.
- Customer agrees and understands that although the web page filtering product blocks a large number of "objectionable" Internet sites, no web page filtering product, including this one, provides a complete block of objectionable web sites. As such, Customer agrees to hold Cablevision harmless from any claims, suits or actions brought by any third party pertaining to the content of any web site accessed by the Power to Learn Internet Service.
- Customer acknowledges that use of the filtering software could impact network performance.
- Although Customer has chosen to purchase filtering from Cablevision, Cablevision cannot enforce its implementation and use. In signing this agreement, Customer is aware of the above and elects to use or not use the web page filtering product provided at the sole risk of the customer.
